Terms Of Service

Scope of Services:

Lease Packet will lease and manage dedicated servers and associated infrastructure to Client.

1. Lease Packet will provide technical support, maintenance, and monitoring services for the servers.
2. Additional services, such as backup solutions, security services, and network enhancements, may be provided as agreed upon between Lease Packet and Client.

Service Level Agreement (SLA):

1. Lease Packet agrees to maintain a high level of uptime for the servers, aiming for 99.9% availability, excluding scheduled maintenance.
2. In the event of service disruption or downtime, Lease Packet will make commercially reasonable efforts to restore services promptly.
3. Lease Packet will not be liable for any damages or losses incurred by Client due to service disruptions, unless caused by gross negligence or willful misconduct on the part of Lease Packet.

Client Responsibilities:

1. Client will provide accurate and complete information required for account setup and management.
2. Client will ensure compliance with all applicable laws and regulations in using the services provided by Lease Packet.
3. Client will be responsible for the security and integrity of their data and applications hosted on the servers.
4. Client will promptly report any suspected security breaches or unauthorized access to Lease Packet.

Payment Terms:

1. Client agrees to pay the fees specified by Lease Packet for the leased server and associated services.
2. Fees are payable in advance on a monthly, quarterly, or annual basis, as agreed upon between Lease Packet and Client.
3. Late payments may result in service suspension or termination, at the discretion of Lease Packet.
4. All fees paid to Lease Packet are non-refundable, except as explicitly stated in a separate agreement between the parties.

Intellectual Property:

1. Lease Packet retains all ownership rights to its hardware, software, and intellectual property used to provide the services.
2. Client agrees not to modify, reverse engineer, or create derivative works based on Lease Packet’s intellectual property.

Confidentiality:

1. Both Lease Packet and Client agree to keep any confidential information exchanged during the course of the agreement confidential and not disclose it to third parties without prior written consent, except as required by law.

Termination:

1. Either party may terminate this agreement by providing written notice to the other party.
2. Upon termination, Client will be responsible for any outstanding fees due up to the date of termination.
3. Lease Packet reserves the right to terminate or suspend services immediately if Client violates any terms of this agreement.

Limitation of Liability:

1. Lease Packet’s liability for any direct damages arising from the services provided under this agreement will be limited to the fees paid by Client for the affected services during the three months preceding the event giving rise to the claim.
2. Lease Packet will not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or business opportunities.

Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in India.

Entire Agreement:

This Agreement constitutes the entire understanding between Lease Packet and Client regarding the subject matter herein and supersedes all prior discussions, negotiations, and agreements.

By signing up for or using the services provided by Lease Packet, Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
